1.1 Grazie per aver scelto Concepció by Nobis e un ringraziamento speciale per aver dedicato del tempo a leggere attentamente le presenti Condizioni d’uso. Vorremmo iniziare con una breve sintesi che spiega perché abbiamo creato queste condizioni.

1.2 Le presenti Condizioni d'uso regolano l'utilizzo del sito web Concepció by Nobis e degli altri servizi forniti, tra cui prenotazioni alberghiere, visite ai ristoranti, conferenze ed eventi, da parte di Concepció by Nobis ora e in futuro (i "servizi").

1.3 Le presenti Condizioni d’uso, insieme al nostro documento separato sulla raccolta, l’utilizzo e la protezione dei dati personali dell’utente (la “Politica sulla privacy”) e a qualsiasi altra condizione specificatamente menzionata in uno qualsiasi di tali documenti, costituiscono un accordo legalmente vincolante (l’“Accordo”) tra l’utente e Concepció by Nobis in relazione all’utilizzo dei servizi da parte dell’utente.

2.2 L'utente è l'unico responsabile dell'accuratezza dei dati e delle informazioni personali forniti durante l'utilizzo dei nostri servizi. Pertanto, l'utente garantisce che tutte le informazioni di registrazione fornite a Concepció by Nobis sono veritiere, accurate e complete, e si impegna a mantenerle tali in ogni momento. Si prega di tenere presente che Concepció by Nobis non si assume alcuna responsabilità in merito alle scelte dell'utente relative alla fornitura di informazioni o all'utilizzo dei nostri servizi.

2.3 Concepció by Nobis may introduce new functions and/or features to our website or our services. These functions and/or features may be bound certain terms of use. If you wish to engage with these functions and/or features, this means that you will be required to accept the new terms of use.
2.4 Concepció by Nobis and our partners may choose to send targeted marketing to our hotel guests, as well as other users of our services. These marketing activities will primarily be carried out through email but can also appear in other types of communication. If you wish to unsubscribe from any marketing activities carried out by Concepció by Nobis, please proceed to our Privacy Policy for detailed instructions.

3. Booking

3.1 When making a reservation for a hotel room, you and Concepció by Nobis will agree on the applicable terms for your stay. The terms will be evident through these Terms of Use as well as through your booking confirmation. For reservations of our conference rooms or bookings at our restaurant, please review the specific terms applicable for those types of reservations.

3.2 If you choose to book a hotel room through our website, your reservation will be managed through a third-party service solution, provided by Sabre Hospitality Solutions and their booking engine SynXis. In order to complete your booking, you must accept the general terms of use of SynXis and, if needed, their specific terms for your booking. When booking a hotel room online, you will also be presented with an opportunity to create an account for a membership in a loyalty program which is provided by Marriott International, Inc. In order to complete your registration, you must accept the general terms of use of Marriott International, Inc.

3.3 Your reservation will become binding once it has been confirmed by Concepció by Nobis. The confirmation of your reservation, as well as your unique confirmation number, will generally be provided in writing, through email. However, depending on how you make your reservation, your confirmation number may be provided by other means of communication.

3.4 You must be aged 18 years or over to make a booking with us and you must be aged 18 years or over to stay alone in one of our hotel rooms. If a guest arrives at the hotel and is under 18 years of age the guest will not be permitted to stay alone. If a person who is over 18 years of age (”adult”) shares the room with a person under 18 years of age (”minor”), the adult assumes complete liability for the minor’s use of the hotel room and our services in general. 3.5 When you stay at our hotel the check-in and check-out times will differ depending on how you make your reservation and which room category you choose. In general, the check-in and check-out times will be communicated on our website our through your booking confirmation. If you wish to receive additional information connected to your reservation, please contact our customer service.

3.6 Reservations can be canceled, different terms and conditions apply. Please see booking conditions in the time of booking. If you fail to cancel your reservation in time, Concepció by Nobis will charge a compensatory flat rate, equivalent to the amount of the first night, from the customer's credit card that was given to guarantee the reservation. Any additional nights reserved will be canceled without charge unless indicated otherwise in the conditions of sale for the rate reserved. 

3.7 In the event of a no-show (reservation not canceled - customer fails to arrive) when a reservation has been guaranteed by credit card, Concepció by Nobis will charge a compensatory flat rate, equivalent to the amount of the first night, from the customer's credit card that was given to guarantee the reservation. Any additional nights reserved will be canceled without charge unless indicated otherwise in the conditions of sale for the rate reserved.

3.8 It is not always easy to find pet-friendly hotels in Palma, but at Concepció by Nobis we are delighted to welcome your furry friends to our lovely hotel. However, the amount of pet-friendly rooms at our hotel is limited. Therefor we can only accept the presence of your pet if you have contacted us in advance of your stay and received a written confirmation of acceptance. If you would like to know more, please feel free to contact our customer service.

4. Payment

4.1 When making a reservation through our website, over the phone or on-site at our hotel, you may pay with either debit or credit cards. Adyen banking services manages all of our banking transactions. Concepció by Nobis does not store any credit card numbers. Payment on invoice is only permissible for company clients, either through a specific agreement or with Concepció by Nobis’s express consent, to which there is no entitlement.

4.2 Our hotel accepts most major debit/credit cards, including Visa, American Express, MasterCard, Diners and Euro Card. When you make a reservation as part of the checkout process you are automatically taken to the Adyen payment facility for debit/credit card payments. Your card details are sent directly to the bank and cannot be read or accessed by anyone other than your bank. The online reservation process is secured using SSL (Secure Socket Layer) technology. This is to prevent anyone from intercepting your credit card details during transmission via the Internet. Your credit card details will never be sent in an email or transmitted by any means other than SSL 

4.3 Your payment is handled by Adyen with secure encryption and under strict banking standards, called PCI DSS (Payment Card Industry Data Security Standard). Payment may in some instances be made using 3D Secure protocol ((Verified by Visa and MasterCard SecureCode), which is designed as an additional security layer for online credit and debit card payments.

4.4 Concepció by Nobis will not apply any extra charge for card payments. Your bank may however apply additional charges depending on your type of debit/credit card. In the event that no payment has been received after placing your reservation, Concepció by Nobis may automatically cancel your reservation.

4.5 In addition to the terms specified in section 4.2. Concepció by Nobis will only accept cash payment in Euro. In a situation where a guest of the hotel wants to pay by any means other than Euro, such as traveler's checks, coupons, foreign currency or other debit or credit cards than those specified in section 4.2, such payment methods must be pre-approved by an authorized representative of Concepció by Nobis.

5. Service limitations and modifications

5.1 Concepció by Nobis will make reasonable efforts to keep our services operational. However, certain technical difficulties or maintenance may, from time to time, result in temporary interruptions. Concepció by Nobis reserves the right at any time and for any reason to suspend, discontinue, terminate or cease providing access to the website or any service provided through our services, temporarily or permanently. In the case of any temporary or permanent suspension, discontinuation, termination or cessation of access, Concepció by Nobis shall use its reasonable endeavours to notify the person(s) of such decision in advance. Any such decision will be made at Concepció by Nobis’s discretion.

5.2 You hereby agree that Concepció by Nobis and its subsidiaries, affiliates, successors, assigns, employees, agents, directors, officers, partners and shareholders shall not be liable to you or to any third party for any changes or modifications to our website or any of our services that Concepció by Nobis may wish to make from time to time, or for any decision to suspend, discontinue or terminate the website, the services or any part or parts thereof, or your possibility to use or access the same from or within any territory or territories.

5.3 Concepció by Nobis may change the features of any type of services, may withdraw or, or introduce new features, products or types of account at any time and for any reason, and may change the prices charged for any of its services from time to time.

6. Data Protection and Privacy

All personal data that you provide to us in connection with your use of the website and our services is collected, stored, used and disclosed by Concepció by Nobis in accordance with our Privacy Policy.

7. Linee guida per gli utenti
Per poter offrire ai nostri visitatori esperienze, servizi e offerte di alta qualità, è fondamentale che tutti possano sentirsi assolutamente al sicuro nelle loro interazioni con il nostro hotel e il nostro sito web. • è offensivo, ingiurioso, diffamatorio, pornografico, minaccioso o osceno
• faccia credere erroneamente o travisi il tuo legame con un altro utente, persona o entità, oppure sia in altro modo fraudolento, falso, ingannevole o fuorviante
• include intenzionalmente dati personali di terzi o è finalizzato alla raccolta di tali dati personali
• interferisca con o interrompa in qualsiasi modo i nostri servizi, manometta, violi o tenti di sondare, scansionare o testare le vulnerabilità dei servizi o dei sistemi informatici, della rete, delle regole di utilizzo di Concepció by Nobis, nonché di qualsiasi componente di sicurezza, misura di autenticazione o altra misura di protezione applicabile ai servizi; oppure
• contiene contenuti dannosi quali malware, cavalli di Troia o virus, oppure interferisce in altro modo con l'accesso ai servizi da parte di qualsiasi utente;
• comporta l'invio di messaggi di posta elettronica di massa non richiesti o altre forme di spam, posta indesiderata o simili

8. Terze parti

8.1 Utilizzando il nostro sito web, all’utente potrebbero essere forniti accessi a siti web, banche dati, reti, server, informazioni, software, programmi, sistemi, directory, applicazioni, prodotti o servizi di terze parti (di seguito “Servizi esterni”).

8.2 Concepció by Nobis non ha né mantiene alcun controllo sui Servizi esterni, né si assume alcuna responsabilità per essi, e non è né può essere responsabile del loro contenuto, funzionamento o utilizzo. Collegandosi o fornendo in altro modo l’accesso a qualsiasi Servizio Esterno, Concepció by Nobis non rilascia alcuna dichiarazione, garanzia o approvazione, espressa o implicita, in merito alla legalità, accuratezza, qualità o autenticità dei contenuti, delle informazioni o dei servizi forniti da tali Servizi Esterni.

9. Proprietà intellettuale

9.1 Tutti i contenuti del sito web sono, salvo diversa indicazione, di proprietà di Nobis Hoteles Palma Spanien.

9.2 Il contenuto del sito web è in ogni suo aspetto protetto dal diritto d'autore, dal diritto dei marchi e da altre leggi sulla proprietà intellettuale. Agli utenti e ai visitatori non è concesso il diritto di utilizzare il contenuto del sito web in alcun modo diverso da quanto previsto dalle Condizioni d'uso.

9.3 Salvo diversa indicazione, la riproduzione, la pubblicazione, l'elaborazione, il trasferimento, l'archiviazione o qualsiasi altro utilizzo dei contenuti del sito web Concepció by Nobis richiede la previa autorizzazione scritta.

9.4 L'utilizzo dei marchi e dei loghi che compaiono sul sito richiede il previo consenso scritto di Concepció by Nobis o, se del caso, di un altro titolare dei diritti autorizzato.

9.5 Le fotografie e le riprese effettuate nei locali di Concepció by Nobis non possono essere utilizzate a fini commerciali senza il previo consenso scritto di Concepció by Nobis. Per "fini commerciali" si intendono, a titolo esemplificativo ma non esaustivo, l'utilizzo a fini di marketing, pubblicità, social media, materiale stampa o in altri contesti che possano essere considerati promozionali o legati all'attività commerciale. L'uso non autorizzato può comportare richieste di risarcimento o altre azioni legali.

10. Indennizzo

Con la presente l'utente accetta di indennizzare, difendere e tenere indenne Concepció by Nobis, i suoi successori, cessionari, affiliati, agenti, amministratori, funzionari, dipendenti, partner e azionisti da e contro qualsiasi rivendicazione, obbligo, danno, perdita, spesa e costo, incluse le ragionevoli spese legali, derivanti da:

• qualsiasi violazione da parte tua delle presenti Condizioni d'uso o di qualsiasi linea guida applicabile; oppure
• qualsiasi reclamo da parte di terzi relativo alla violazione del diritto d'autore o di altri diritti di proprietà intellettuale, o alla violazione della privacy, derivante dalle azioni dell'utente in relazione al nostro sito web e ai nostri servizi

11. Disposizioni varie

11.1 Concepció by Nobis può cedere i propri diritti e obblighi derivanti dalle presenti Condizioni d’uso, in tutto o in parte, a qualsiasi terza parte in qualsiasi momento e senza preavviso, ivi incluse, a titolo esemplificativo ma non esaustivo, eventuali persone fisiche o giuridiche che acquisiscano la totalità o la quasi totalità delle attività o del patrimonio di Concepció by Nobis. L'utente non può cedere le presenti Condizioni d'uso o i diritti e gli obblighi da esse derivanti, in tutto o in parte, a terzi senza il previo consenso scritto di Concepció by Nobis. Qualsiasi richiesta di cessione di diritti sarà gestita a esclusiva discrezione di Concepció by Nobis.

11.2 Qualora una o più disposizioni delle presenti Condizioni d’uso fossero ritenute illegali, nulle o inapplicabili, tali disposizioni saranno considerate separabili e non pregiudicheranno la validità e/o l’applicabilità delle restanti disposizioni delle Condizioni d’uso, che rimarranno pienamente in vigore ed efficaci. 

11.3 Qualsiasi potenziale controversia sarà risolta in conformità con la legge svedese presso il Tribunale distrettuale
di Stoccolma.
